Workers' Compensation/Death/Statute Of Limitations

If an injury is caused by radiological material or equipment or asbestos an Application must be filed within 25 years of the last day the employee was employed in the environment of hazardous radiological activity or asbestos. If death results form accidental injury, an Application for Compensation for Death may be filed with the Commission within three years after the date of death if no compensation was paid or within two years after the date of the last payment of compensation, which ever is later. If death is due to exposure to radiological material or equipment or asbestos within 25 years after the last day the employee was so exposed, Application for Compensation for Death may be filed within three years after the date of death if no compensation has been paid or within two years after the last payment of compensation, which ever is later.
