Workers’ Compensation/Injuries Occurring On Parking Lots

To establish compensability for injury sustained because of some condition in a parking lot, the employee must show that the employer in some way provided the parking facility where the injury occurred. As an example, when an employee going to work slipped and fell in a parking lot that was neither controlled or owned by the employer and the employee was not required to use the route taken, the injury caused by the employee’s fall is not compensable. Injuries sustained on a company parking lot as a result of an artificially created condition are compensable provided the injury is incidental to the normal use of the lot.
