Workers’ Compensation/Pre-Existing Injuries And Diseases

The employer takes the employee as he or she is. The workers’ compensation law is for the old and the young, the diseased and the healthy. If a pre-existing condition is aggravated, exacerbated or accelerated by an accidental injury, the employee is entitled to benefits. The employer is not responsible for a pre-existing disease or pre-existing disabling condition that the employee brought to the employment or developed independently of the employment. However, an employee is not automatically precluded from receiving benefits just because he or she has a pre-existing condition.
